1. Provider Information
These Terms of Service (“Terms”) are entered into between you (“User”, “you”) and:

By accessing or using Lustre (“Service”, “Platform”), you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Description of the Service
Lustre is a software-as-a-service (SaaS) platform that enables businesses to collect, manage, curate, and display customer testimonials and social-proof widgets on their websites. The Service includes testimonial collection forms, a management dashboard, embeddable widgets, analytics, and related features as described on our website.
We offer free and paid subscription plans with varying features and usage limits. The specific features available under each plan are described on our pricing page and may be updated from time to time.
3. Account Terms
- You must be at least 18 years of age (or the age of majority in your jurisdiction) to use Lustre.
- You must provide accurate, complete, and current registration information and keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must notify us immediately at support@uselustre.com if you suspect any unauthorised use of your account.
- One person or legal entity may maintain no more than one free account at a time.
4. Payment Terms
- Paid plans are billed in advance on a monthly or yearly basis, as selected at the time of purchase.
- Payments are processed by Mollie B.V. (Amsterdam, Netherlands). We accept payments in EUR and USD. Available payment methods are determined by Mollie and may vary by region.
- All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any VAT or sales tax applicable in your jurisdiction.
- You may cancel your subscription at any time. Upon cancellation, your paid features will remain active until the end of the current billing period. No partial refunds are provided for unused time within a billing period.
- We reserve the right to change our prices with at least 30 days written notice. Price changes take effect at the start of the next billing cycle following the notice period.
- If a payment fails, we will notify you and may suspend access to paid features after a reasonable grace period (typically 7 days).
5. Intellectual Property
The Service, including its original content (excluding User Content), features, functionality, design, code, and documentation, is and remains the exclusive property of Pelle Krukow and is protected by copyright, trademark, and other intellectual property laws.
“Lustre”, the Lustre logo, and associated marks are trademarks of Pelle Krukow. You may not use these marks without prior written consent.
6. User Content and Testimonials
- Your content:You retain full ownership of all testimonials, text, images, and other content you collect, upload, or create through Lustre (“User Content”).
- License to us: By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, display, and transmit your User Content solely to the extent necessary to operate and provide the Service (e.g. rendering widgets on your website).
- Testimonial authors: Testimonial authors retain the rights to the content they submit. You are responsible for ensuring you have the necessary permissions to collect and display third-party testimonials.
- Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not endorse any User Content.
7. Acceptable Use
You agree not to:
- Submit, publish, or display fake, fabricated, or misleading testimonials.
- Use the Service for spam, phishing, harassment, or any unlawful purpose.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
- Access the Service through automated means (bots, scrapers) except through our official API.
- Resell, sublicense, or redistribute access to the Service without our written permission.
- Violate any applicable local, national, or international law or regulation, including the GDPR.
We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice, depending on the severity of the violation.
8. Service Availability
We strive to maintain high availability (target: 99.9% uptime) but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable advance notice. Emergency maintenance may be performed without prior notice. We reserve the right to modify or discontinue features with at least 30 days notice.
9. Limitation of Liability
To the maximum extent permitted by applicable law, and subject to the mandatory provisions of German law (in particular §§ 521, 523, 524 BGB and liability for intent and gross negligence under § 276 BGB):
- For slight negligence: We are only liable for breaches of material contractual obligations (Kardinalpflichten). In such cases, our liability is limited to the foreseeable, typically occurring damage.
- Cap: Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the total fees paid by you to us during the twelve (12) months immediately preceding the event giving rise to the claim, or EUR 100, whichever is greater.
- Exclusions: We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, to the extent permitted by law.
- Unaffected: This limitation does not affect liability for damages arising from injury to life, body, or health, or liability under the German Product Liability Act (Produkthaftungsgesetz), or for intentional misconduct or fraudulent misrepresentation.
10. Warranty Disclaimer
The Service is provided on an “as is” and “as available” basis. To the extent permitted by German law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that operation will be uninterrupted or error-free.
Nothing in this section affects your statutory warranty rights under mandatory German law (§§ 434 ff. BGB).
11. Termination
- By you: You may terminate your account at any time through your dashboard settings or by contacting support@uselustre.com.
- By us: We may suspend or terminate your account if you breach these Terms, fail to pay applicable fees after a grace period, or if continued provision of the Service becomes unlawful. We will provide reasonable notice where possible.
- Effect of termination: Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination. After that period, we will delete your data in accordance with our Privacy Policy.
- Survival: Sections relating to intellectual property, limitation of liability, warranty disclaimer, governing law, and dispute resolution survive termination.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law provisions.
The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Hamburg, Germany, to the extent permitted by law. If you are a consumer within the EU, you retain the right to bring proceedings in the courts of your place of residence.
13. Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
We encourage you to contact us first at legal@uselustre.com so that we can attempt to resolve any issue informally before formal proceedings are initiated.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic purpose of the invalid provision.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
